Spanish lawyer Luis Bertelli defends major cases, and prepares appeals for lodging with the Supreme Court, the Constitutional Court, and the European Court of Human Rights in Strasbourg. Predictably such cases are highly complex which are referred to him by other lawyers. The quality which best defines him is that he will never stop fighting until he achieves his clients’ rights. Educated in Germany, he takes his profession very seriously and does not tolerate injustice. His insistence that the Law must prevail over the whims of Judges has led him to be highly successful, even in cases that other lawyers had walked away from, thinking nothing more could be done for their clients. The greatest praise that he receives time and time again from his clients is when they tell him he doesn’t look like a typical lawyer.

He also writes books with which he tries to make people aware of the importance of fighting for their rights and instructing them on the various legal methods available. When Bertelli’s ‘Collection of Fundamental Rights’ was published, it was hailed unanimously as being of incalculable value owing to the wealth of useful and important information it contained. This Compendium of Rights for citizens, which is more comprehensive and elaborate, offers answers and solutions that have never been offered previously in relation to problems with the Spanish judicial.

Review of Volume I

When we prepare for, or are even already involved in, a court procedure, we must be clear that we will begin by accepting what is called a process of collaboration. This means that we respect the established order: adversarial parties and an impartial judge presiding. However, if this equilibrium is upset and the person who should remain independent of the interests at stake -the judge- is guilty on any of the established grounds justifying recusal as established by law, but continues to hear the case, or he or she takes the side of the opposing party, thus giving strong motives for suspicion of partiality, we must without hesitation in these situations move to a confrontation in which we question the acceptability of the judge.

Only with an impartial judge can there be the assurance that justice will be done, and as the interested party that we are, we should try to remove him or her at all costs if he or she is clearly siding with the other party… in the following we will show that any judge may be made to stand down if he or she acts in a way that can be shown to be lacking in impartiality. We will explain what has to be done and will provide documents for the accuser’s guidance. Moreover, we confirm that a judge suspected of bias can easily be moved off a case, contrary to widespread opinion, which holds that such a possibility is very limited.
